The decision of the Inter-American Court of Human Rights (IACHR) calls on the signatory countries of the American Convention, including Panama, to adapt their regulations and practices to approve same-sex marriage. The document entitled "Advisory opinion on gender identity and non-discrimination of same-sex couples" states it is not about detracting from the institution of marriage," on the contrary, it was deemed necessary to recognize equal dignity of persons belonging to a human group that has been historically oppressed and discriminated".

The Court's opinion responds to a request for interpretation of Costa Rica on the protection afforded by the American Convention to the human rights of the LGBTI community.
